These Terms of Service (“Terms”) govern purchases from and use of Card Ark (“Card Ark,” “we,” “us,” or “our”). By submitting an order, paying an invoice, or using our website or services, you agree to these Terms.
Card Ark creates custom-designed, laser-engraved collectible card binders based on information, ideas, themes, references, and other materials provided by each customer.
Because every Card Ark binder is made to order, customers are responsible for reviewing all information and design proofs carefully before approving their order for production.
Card Ark reserves the right to accept or decline any order or requested design at our discretion.
A $20 deposit is required to begin the order process and is applied toward the final purchase price.
After reviewing your order request, Card Ark will provide a final invoice. Design work begins after the final invoice has been paid.
Any applicable shipping charges, taxes, or other disclosed fees will be included in or added to your order as appropriate.
Card Ark will create a custom design based on the information, ideas, and inspiration provided with your order.
Each order includes up to three rounds of design revisions unless otherwise agreed in writing.
Additional revisions or significant changes to the original design direction may require an additional fee. Card Ark will disclose any additional charge before performing that work.
You will receive a final design proof before your binder is engraved.
By approving your proof, you confirm that you have reviewed and accepted the artwork, spelling, text, placement, orientation, and overall design and authorize Card Ark to permanently engrave the approved design.
You may change or cancel your order for a refund at any time before approving your final design proof.
Once the final proof has been approved, the order is final and cannot be changed, canceled, or refunded.
If Card Ark damages a binder during production, Card Ark will reproduce the binder at no additional cost to the customer. Production damage by Card Ark does not alter the customer's approved design or create a right to cancel an otherwise final order.
Customers may provide images, artwork, photographs, logos, characters, references, or other materials to communicate their desired design.
Customers represent that they have the right to provide any materials they submit to Card Ark and authorize Card Ark to use those materials as necessary to create their requested custom product.
Card Ark may adapt, redraw, reinterpret, combine, simplify, or otherwise modify reference materials when creating artwork for engraving.
Card Ark reserves the right to refuse any material or requested design that we believe cannot or should not be used.
The customer owns the physical binder purchased from Card Ark.
Unless otherwise agreed in writing, all original artwork, layouts, design files, engraving files, proofs, and other creative work produced by Card Ark remain the property of Card Ark.
Purchase of a binder does not transfer ownership of Card Ark's underlying artwork or design files and does not include editable, source, or production files.
The customer may, of course, photograph, display, share, and enjoy their finished physical binder for personal use.
Laser engraving is a physical process, and the appearance of an engraved binder may vary slightly from digital proofs or photographs.
Variations in binder material, texture, engraving tone, positioning, and other minor characteristics are normal and are not considered defects as long as the finished product reasonably reflects the approved design.
Colors displayed on screens may also vary from the appearance of the physical binder.
Most Card Ark binders are completed and shipped within approximately 2–3 weeks after the final invoice is paid.
Turnaround times are estimates and are not guaranteed. Timing may vary due to order volume, design complexity, Vault X binder availability, shipping delays, or other circumstances outside Card Ark's reasonable control.
We will make reasonable efforts to communicate significant delays affecting your order.
Shipping is a flat $10 within the United States, unless otherwise stated.
Customers are responsible for providing a complete and accurate shipping address. Card Ark is not responsible for delays or delivery issues caused by incorrect information provided by the customer.
Tracking information will be provided when available.
Card Ark is not responsible for carrier delays after an order has been transferred to the shipping carrier.
Every Card Ark binder is inspected before it leaves us.
If your binder is damaged by Card Ark during production, we will replace it at no additional cost.
If your binder is damaged during shipping, you will need to file a claim through the shipping carrier using the shipment's insurance. Card Ark will provide reasonably available information needed to assist with the claim.
Damage that occurs after delivery due to use, handling, accidents, improper storage, improper care, or other customer-caused damage is not covered by Card Ark.
Card Ark may photograph, record, display, publish, and otherwise use images or video of completed binders and their designs for our portfolio, website, social media, advertising, promotional materials, and other Card Ark business purposes.
Unless otherwise agreed in writing before production, all binder designs and completed binder content may be publicly displayed and used by Card Ark for these purposes.
Card Ark will not intentionally publish a customer's private contact, payment, or shipping information as part of this content.
Card Ark reserves the right to refuse or cancel an order or requested design that is unlawful, threatening, hateful, obscene, infringing, technically unsuitable for production, or otherwise inappropriate for Card Ark to produce.
If Card Ark cancels an order before production for one of these reasons, amounts paid for work that has not already been performed will be handled as determined by the circumstances and applicable law.
To the fullest extent permitted by applicable law, Card Ark will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, services, or products.
To the fullest extent permitted by law, Card Ark's total liability relating to an order will not exceed the amount paid to Card Ark for that order.
Nothing in these Terms limits any rights or remedies that cannot legally be limited under applicable law.
You may use the Card Ark website for lawful personal purposes related to learning about, communicating with, or purchasing Card Ark products and services.
Content created by or for Card Ark, including our branding, website content, photographs, graphics, and original designs, may not be reproduced or commercially used without our permission except as permitted by law.
We may update these Terms from time to time. Changes will be reflected by updating the “Last Updated” date above.
The Terms applicable to an order will generally be those in effect when the order is placed, except where changes are required by law or otherwise agreed between Card Ark and the customer.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Any rights available to consumers under applicable federal, state, or local law remain unaffected.
